Couple fights for custody of grandchild placed in foster care

As a grandparent in San Antonio, Texas, you may expect to be notified in the event that your grandchildren’s parents can no longer care for them. This is a reasonable expectation, but one that was denied to a set of grandparents recently.

The two are paternal grandparents to a 5-year-old child who was removed from her mother’s custody in 2011. The mother was addicted to drugs and evidently had run into trouble taking care of her daughter. The grandparents claim that they were never notified that their granddaughter was placed into foster care. Instead, they allege that a social worker for the Division of Child and Family Services (DCFS) did not file the right paperwork that would ensure their grandparents’ rights and that the girl’s care would be entrusted with them. 

Instead, the grandparents had to track down their granddaughter themselves, something that took them over a month to do. Once the girl was found, they probably thought their ordeal was over and that the girl would certainly come and live with them, but that was not the case.

The grandparents are currently in a custody battle with the girl’s foster parents who wish to adopt her. The grandparents have hired an attorney to help them get custody. They are also pursuing a legal claim against DCFS.

This is a situation that no grandparent should have to face. If you have found yourself in a similar circumstance, you may wish to speak with an attorney about your case. Having someone in your corner fighting for your rights can be extremely helpful in cases like this.
