Usher's ex-wife requests custody of children after pool accident

When two people with children divorce, it is beneficial for the children's sake that the two come together and agree on the terms of the divorce, including who will get primary custody. Oftentimes, though, this isn't possible and it is necessary for a judge to decide what is in the best interests of a child. Sometimes this judgment may be called into question later in the event that an accident occurs.

This is the case for a child custody battle over R&B singer Usher's two children. Usher has primary custody of the children, but his ex-wife would like to see that change after their 5-year-old son nearly drowned while in the care of his aunt.

The accident happened recently when the boy became stuck in the drain at the bottom of the pool. After a housekeeper tried unsuccessfully to get him out, a contractor that was doing work on the home was able to free him and start performing CPR. The boy was taken to the hospital to recover from the ordeal.

Usher’s ex-wife requested a hearing to award her temporary primary custody of the two children and the ability to have the authority for decision-making in their behalf. The judge denied her request and ruled that there was virtually no way to prevent the accident, and that no one was at fault. He did tell the singer to let his ex-wife know where he was going to be and who was watching the children when he was not with them.
