Mother sentenced to jail time for child custody breach

Texas state family law rulings are legally binding and, therefore, enforceable under the law. Anyone who fails to comply with the terms of his or her child custody agreement can be subject to a number of legal penalties, including a jail sentence in some cases. And while the Texas family court system typically implements a number of enforcement techniques before issuing jail sentences, one recent case illustrates that such measures are still taken to uphold custody and visitation agreements.

Deion Sanders was awarded primary custody of his three children in 2013, after the divorce from his wife was finalized. The ex-wife of the celebrity football player was awarded visitation rights to the children. However, those visitation rights were recently suspended by a Collin County district judge after the mother of three was found guilty of making disparaging comments about her ex-husband. Beyond that, it was determined that the ex-wife would serve a seven days jail sentence for violating the terms of the child custody and visitation agreement.

Sanders’ attorney had requested the child custody hearing to address concerns over the ex-wife failing to abide by her visitation guidelines. And while she reportedly did not comment on the recent court decision, she was accused of making public defamatory comments against the retired football player in the past. Legal proceedings over the defamation accusations are expected to proceed.

Enforcing the terms of a legally established child custody agreement can be the most effective way to ensure that both parents are held accountable for their legal obligations and actions. An experienced attorney can help clients understand when and how to pursue modifications to their custody agreement.
